1. Introduction and Acceptance

Welcome to ZenSport ("Platform", "Service", "we", "us", or "our"). ZenSport is a sports club management platform operated by ZenSport SRL, a company registered in Romania.

By accessing or using our Service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

These Terms apply to all users, including club administrators, staff members, players, and parents/guardians.

2. Definitions

• Platform: The ZenSport web application and all related services
• User: Any individual who accesses or uses the Platform
• Club: A sports organization registered on the Platform
• Member: A player, staff member, or parent registered within a Club
• Personal Data: Any information relating to an identified or identifiable natural person
• Controller: The entity that determines the purposes and means of processing Personal Data

3. Account Registration

3.1 Eligibility

You must be at least 16 years old to create an account. Users under 16 may have accounts created on their behalf by a parent or guardian.

3.2 Account Information

When registering, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information as needed
• Keep your login credentials secure and confidential
• Notify us immediately of any unauthorized access

3.3 Account Types

• Club Administrator: Full access to manage club settings, members, and data
• Staff/Coach: Role-based access as defined by the club administrator
• Player: Access to personal data, schedules, and team information
• Parent/Guardian: Access to manage children's data and respond on their behalf

4. Service Description

ZenSport provides sports club management tools including:

• Team and player management
• Activity scheduling and attendance tracking
• Communication tools
• Document management
• Financial tracking and fee management
• Performance analytics
• Equipment management

5. User Responsibilities

5.1 Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms.

5.2 Prohibited Activities

You may not:

• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Upload malicious code or interfere with the Service
• Attempt unauthorized access to any part of the Service
• Collect personal data without proper authorization
• Share login credentials with unauthorized persons
• Use the Service to send spam or unsolicited communications

6. Club Responsibilities

Clubs using ZenSport are responsible for:

• Obtaining proper consent for data collection from members
• Ensuring parental consent for minor members (under 16)
• Maintaining accurate member records
• Complying with applicable data protection regulations
• Managing access permissions appropriately
• Responding to member data requests

7. Data Protection

7.1 Data Processing

We process personal data in accordance with our Privacy Policy and applicable data protection laws, including the General Data Protection Regulation (GDPR).

7.2 Data Controller

• ZenSport acts as a Data Processor for club member data
• Each Club acts as the Data Controller for their members' data
• ZenSport acts as Data Controller for user account data

7.3 Sub-processors

We use carefully selected third-party service providers to help deliver our Service. A list of sub-processors is available upon request.

8. Subscriptions and Payments

8.1 Subscription Plans

Clubs may subscribe to various service plans with different features and limits. Current pricing and plan details are available on our website.

8.2 Billing

• Subscriptions are billed in advance on a monthly or annual basis
• Prices are in EUR and exclude applicable taxes
• We accept major credit cards and bank transfers

8.3 Refunds

• Annual subscriptions may be refunded within 14 days of purchase
• Monthly subscriptions are non-refundable
• Refunds are processed to the original payment method

8.4 Plan Changes

You may upgrade or downgrade your plan at any time. Changes take effect at the start of the next billing period.

9. Intellectual Property

9.1 Our Property

The Platform, including its design, features, content, and functionality, is owned by ZenSport and protected by intellectual property laws.

9.2 Your Content

You retain ownership of content you submit to the Platform. By submitting content, you grant ZenSport a non-exclusive, worldwide license to use, store, and display your content as necessary to provide the Service.

9.3 Restrictions

You may not copy, modify, distribute, or reverse engineer any part of the Platform without our prior written consent.

10. Termination

10.1 By You

You may terminate your account at any time through account settings or by contacting support.

10.2 By Us

We may suspend or terminate your access if you:

• Violate these Terms
• Fail to pay subscription fees
• Engage in fraudulent or illegal activities
• Have been inactive for an extended period

10.3 Effect of Termination

Upon termination:

• Your right to use the Service ceases immediately
• We will retain data as required by law or as specified in our Privacy Policy
• You may request export of your data before termination

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZENSPORT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless ZenSport and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Platform. Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms.

15. Governing Law and Disputes

15.1 Governing Law

These Terms are governed by the laws of Romania, without regard to conflict of law principles.

15.2 Jurisdiction

Any disputes shall be resolved in the courts of Bucharest, Romania, unless otherwise required by applicable consumer protection laws.

15.3 EU Consumer Rights

If you are a consumer in the European Union, you retain any mandatory rights under EU consumer protection law.
